Terms & Conditions

By engaging with Webafy Digital Services ("the Company") for AI visual marketing, 3D rendering, or cinematic ad production, you agree to be bound by these Terms and Conditions. These terms apply to all clients in South Africa, including those in Johannesburg, Cape Town, Durban, Pretoria, Pietermaritzburg, Ladysmith, and other locations.

Webafy provides AI-powered visual marketing services, including but not limited to:

• Cinematic AI-enhanced product visuals and 3D renders.
• Video advertisement production.
• Brand visual identity development.
• SEO-optimized website development.
• Digital marketing strategy and implementation.

All services are delivered remotely to clients across South Africa.

All project fees are quoted in South African Rand (ZAR) and are payable as per the agreed schedule. A 50% deposit is typically required before project commencement. Final payment is due upon delivery.

Due to the bespoke, digital nature of our deliverables, refunds after project commencement are at the Company's sole discretion. Creative revisions are included as specified in individual project agreements.

Upon full payment, the Client receives a perpetual, worldwide license to use the final delivered assets for the agreed purposes. Webafy retains the right to display work in portfolios and marketing materials unless otherwise agreed in writing.

Source files, AI prompts, and production methods remain the intellectual property of Webafy and are not included in standard deliveries.

Webafy shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our services or deliverables. Our total liability shall not exceed the fees paid by the Client for the specific project in question. This limitation applies to all clients regardless of their location within South Africa.

The Client agrees to:

• Provide accurate brand assets, briefs, and feedback in a timely manner.
• Ensure they have the legal right to use any materials provided to Webafy.
• Communicate project requirements clearly and respond to queries within 5 business days.
• Make payments according to the agreed schedule.

Both parties agree to keep all project details confidential. Webafy will not disclose client information to third parties without consent, except where required by South African law.

Either party may terminate the engagement with 14 days written notice. Upon termination, the Client shall pay for all work completed to date. Any deposits paid are non-refundable unless otherwise agreed.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
